SUM Hospital Owner Manoj Nayak Sent To 2-Day Police Remand

Bhubaneswar: Manoj Ranjan Nayak, owner of Institute of Medical Sciences (IMS) and SUM Hospital has been sent to two-day police custody after being produced before the Sub Divisional Judicial Magistrate (SDJM) Court here on Thursday evening amid tight security.
The Commissionerate Police had applied to take Nayak for three days remand.
The SDJM Court directed the police to produce Nayak before it on October 23 after the end of his three-day remand period.
Nayak was, however, sent to Jharpada Jail on judicial custody
Speaking to media persons, Nayak’s defence counsel S N Das said that his client’s bail plea was rejected by the court on technical grounds since SDJM Court has no jurisdiction to decide the matter as because 304 IPC is a section which can be tried by the Sessions Court and not by a Magistrate. Only on that ground the bail petition was rejected.
The Cuttack-Bhubaneswar Twin City Commissionerate Police had applied for a three-day remand of Nayak for further interrogation.
The city police amid tight security produced him before the court after interrogating him at an undisclosed place on the day.
Nayak has been booked under Sections 304, 308, 285, and 34 of the Indian Penal Code (IPC).
At about 3.30 am on Wednesday, Nayak, who is one of the managing trustees of Siksha ‘O’ Anusandhan Charitable Trust, surrendered at Khandagiri police station and was later arrested.
A case has been registered under Sections 304 (culpable homicide not amounting to murder), 308 (attempt to commit culpable homicide), 285 (negligent conduct with respect to fire or combustible mat­ter) and 34 (acts done by several persons in furtherance of common intention) of the IPC.
Following the issuance of look-out circular by the Commissionerate Police against him and his wife on Wednesday, Nayak surrendered before the Khandagiri Police Station at 3.30 am on Wednesday night and was arrested.
Police had reportedly conducted raids at Nayak’s residence and several places connected with his business and is said to have seized several incriminating documents.
It may be recalled here that 19 patients undergoing treatment at the SUM Hospital had died due to asphyxiation owing to the massive fire on Monday that originated from the dialysis ward on the first floor and spread to the ICU on the same floor. In the incident, over 100 others sustained injuries and were shifted to various government and private hospitals. With three more relocated patients succumbing, the death toll due to the mishap has risen to 21.
The police had arrested four officials of Sum Hospital– Medical Superintendent Puspa Raj Samantasinghar, Amulya Sahu, Electrical Maintenance Engineer, Fire Safety Officer Santosh Das and Junior Engineer (Electrical Maintenance) Malaya Kumar Sahu– on the basis of the FIR lodged by the Directorate of Fire Services.
